Thank you for this email, and addressing my concern raised this past Saturday, but as Chief Parker mentioned, I have already resolved them.
I documented her answer myself on camera, and it already has nearly ten thousand views on social media. I have obtained a copy of the audio of the pastor's call Saturday, as well as the associated notes, and also received audio of OPD contacting LPD regarding my lawful drone usage at his church the following Sunday morning - it seems that OPD requested a supervisor on behalf of one of his parishioners, to which I have to be genuinely appreciative of, Sgt. Bartz was able to document that I hadn't been doing anything unlawful, and advise members of the congregation not to engage when I return with signs in future weeks. He seemed to be genuinely nerding out about my drone, and was quite friendly.
I appreciate your reassurance, but "no report was completed" for one of the complaints Mike Burgess made about me, but I was still arrested based on his allegations and the "information from the call" weeks after his complaint. The arresting officer, Allison, referenced an email from Serano while I was handcuffed in Hegge's backseat.
So, as I explained during my public comment to city council later that meeting, the reason I had to go up to her and ask is because I was unsure if I was subject to arrest at any point in time, as the Olympia Police Department apparently felt after a different fascist called them on me, claiming theft, providing a photo of me and my partner standing at the corner of a downtown intersection as "evidence".
Additionally, as you're likely aware, I was then threatened with a second unlawful arrest for constitutionally protected activity (advising someone of their fifth amendment right not to answer officers from across the street, a complaint has already been filed and Lt. Weinnig has already made his sergeants aware of the instance), which shows me that this isn't just one or two officers who thinks this process was acceptable. If ANY of your officers (or any government employee, really) believes that their job is interfered with by the people being educated on their rights, then I think it's important you reflect on what job they're doing that requires people to be ignorant of their rights for it to be carried out.
I was actually hoping to speak to you, at city council, and surprised to see her instead. I wanted to ask you why I was not arrested either of the times I attended city council, after your officers believed they had probable cause, and not until I was engaged in the constitutionally protected act of recording them. This is a question she cannot answer, as she was not at council either of those times, but you were both of them.
I am concerned, in part, because it seems OPD targeted me based on the wishes of a Michael Burgess from Aberdeeen, who had been informed I was arrested and seemed to have inside knowledge from the OPD that there is no public record of being provided to him. I was wary that the OPD would uphold this same pattern of supporting fascists with pastor Matt Lepage, and that I would be unlawfully arrested a second time. This concern is truly furthered by seeing how often your department arrests people on "Suspicion of warrant", and it is extremely concerning to me that your officers seem to have a checklist that includes telling people when they are about to use force but does not include making sure an arrest is lawful prior to doing it. It would also appear they have not received sufficient constitutional training, as they are unfamiliar with EJJ vs State and believed I could be detained for speech from across the street.
Respectfully, I do not have any faith in your officers availability or ability to make sure that things remain calm when tensions rise, and recognize that historically you have been called to these events as a weapon against progressives by conservative nazi-apologists who like violence and voted for/support a childrapist. From OPD records, in the past, when Michael Burgess assaulted a small black person, and then called OPD on them for pushing back, you supported Mike Burgess and chased the black person.
I'll see you next council - for my own comfort I have been calling the Thurston county public defenders office weekly to ensure I don't have a warrant out, and I will likely be asking you weekly if there's any outstanding probable cause based on any complaints received. I guess if you're amicable, I could do this through email instead, but figured if we were both going to be at council that was easiest.
To be up front, I do intend to continue recording your officers in their interactions, and I may continue talking to people they are detaining for the purposes of ensuring they are safe and familiar with their right to remain silent, and deceptive practices that may be used to get them to incriminate themselves. I also may exercise my first amendment rights to be disrespectful to police, especially when I run into Officers Allison and Hegge again. I believe that it is well within their professional responsibility to handle being mocked, name called, and publicly shamed without retaliation and that their unprofessional and unlawful targeting of me is a demonstration of their personal/political ideologies as well as a concerning pattern of practice by the OPD. I see in the blotter that they often arrest people on "suspicion of a warrant" and I recognize that not everyone has the social or financial support to be bailed during their third game of chess like I was - OPD is ruining lives to keep it's streets more aesthetic, and I intend to use my privileges platforms and skill-sets to discourage this by making the public aware of this behavior, and holding your officers and department accountable - whether or not you have functional internal systems of accountability of your own.
